LIABILITY WAIVER & ASSUMPTION OF RISK

This Rental Agreement, Liability Waiver, and Assumption of Risk (“Agreement”) is made between The Full Xperience (“Company”) and the undersigned customer (“Renter”) in connection with the use of the Company’s rental services. As a condition of renting any equipment—including interactive inflatables, BB guns, or any other items that may pose a risk of damage or injury—the Renter is required to review and agree to all terms and conditions outlined below.

 

1. EQUIPMENT RENTAL

Renter agrees to rent the following equipment from Company, including but not limited to:

  • Bounce houses and inflatable attractions

  • Interactive inflatable games

  • 360 rolling cars

  • BB gun and target setups (adults only)

  • Dodgeball and other physical activity-based games

  • Any additional rental items provided by Company

Renter accepts full responsibility for the care, supervision, and proper use of all rented equipment during the rental period.

2. ASSUMPTION OF RISK

Renter understands and acknowledges that the use of inflatable equipment, mobile ride-on vehicles, BB guns, and physically interactive games involves inherent risks, including but not limited to:

  • Falls, slips, collisions, or overturning

  • Equipment malfunction or misuse

  • Projectile-related injuries (Throwing Darts, BB gun activities)

  • Physical exertion injuries

Renter voluntarily assumes all risks associated with participation and use of the rented equipment, whether known or unknown.

3. LIABILITY WAIVER & RELEASE

To the fullest extent permitted by law, Renter agrees to release, waive, and discharge The Full Xperience, its owners, employees, contractors, and affiliates from any and all liability, claims, demands, or causes of action arising out of or related to:

  • Personal injury or death

  • Property damage or loss

  • Any incident occurring during setup, use, or removal of equipment

This waiver applies even if caused by negligence, except in cases of gross negligence or willful misconduct.

4. SUPERVISION REQUIREMENTS

  • Renter agrees to provide adequate adult supervision at all times during equipment use.

  • Children must be supervised by responsible adults.

  • BB gun rentals are strictly for adults only (18+) and must be used in a controlled, designated area.

  • The Company does not provide supervision unless explicitly agreed in writing.

5. SAFE USE & OPERATING RULES

Renter agrees to ensure that all participants:

  • Follow all posted and provided safety rules

  • Use equipment only for its intended purpose

  • Remove shoes, sharp objects, and prohibited items before entering inflatables

  • Do not engage in rough play, flips, or unsafe behavior

  • Use BB guns responsibly and only at designated targets

  • Follow all local laws and ordinances

6. WEATHER & ENVIRONMENTAL CONDITIONS

Renter acknowledges that:

  • Equipment must not be used during high winds, rain, lightning, or unsafe weather conditions

  • Company reserves the right to cancel or terminate use due to safety concerns

  • No refunds will be issued for unsafe usage due to Renter’s failure to follow weather guidelines

7. SITE PREPARATION & RESPONSIBILITY

Renter agrees to:

  • Provide a safe, level, and clear setup area

  • Ensure access to required power sources (if applicable)

  • Keep equipment secured and protected from damage

Renter assumes responsibility for any damage caused by misuse, negligence, or failure to follow guidelines.

8. INDEMNIFICATION

Renter agrees to indemnify and hold harmless The Full Xperience from any claims, damages, losses, or expenses (including legal fees) arising out of:

  • Renter’s use or misuse of equipment

  • Participant actions

  • Failure to follow safety rules

9. DAMAGE & LOSS

Renter agrees to return all equipment in the same condition as received.
Renter is responsible for:

  • Repair or replacement costs due to damage, theft, or loss

  • Cleaning fees if equipment is returned excessively dirty

10. BB GUN ACTIVITY ACKNOWLEDGMENT (ADULT USE ONLY)

Renter acknowledges that BB gun activities:

  • Are restricted to participants 18 years and older

  • Require strict adherence to safety procedures

  • Must include protective eyewear at all times

  • Must be conducted in a controlled, designated shooting area

Failure to comply may result in immediate termination of rental without refund.

11. PHOTO & MEDIA RELEASE

Renter grants permission for Company to use photos or videos taken during the event for promotional purposes unless otherwise stated in writing.

 

12. GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the state/province in which the rental takes place.

 

13. ACKNOWLEDGMENT

By signing below, Renter acknowledges that they have:

  • Read and fully understand this Agreement

  • Voluntarily agree to all terms and conditions

  • Assumed all risks associated with the rental and use of equipment
